PRESENT: Mayor Gilman; Council members Bill Ennis, Daryl Garrison, William Gordon, Jack Jensen, Donald Mounce and Jeff Sanner; William Gordon was excused; City Manager Tracy Williams; Assistant City Manager David W. Rowlands; Law Director Patrick Carney; Service Director Don Hill; Police Chief Don Rice; Deputy Chief of Police Richard Barnhart; Fire Chief Jack Keister; Director of Planning and Economic Development David Humphreys; Parks and Recreation Director Rick Bolton; and Assistant Clerk of Council Patricia Replogle.
The meeting was called to order by Mayor Gilman. Pastor Michael Carosiello of the New Life Tabernacle Assembly of God gave the invocation. The Pledge of Allegiance and Roll Call followed.
MINUTES
A motion was made by Mr. Sanner and seconded by Mr. Ennis to approve the minutes of the Regular Meeting of July 22, 1997. A unanimous roll call vote carried the motion.
PUBLIC HEARINGS
Ordinance No. 3060: Noise Control.
Chief Rice presented a staff report to Council regarding the proposed noise control ordinance. The current Noise Ordinance was adopted in 1980 with amendments passed in 1986. Proposed changes include, but are not limited to, limitations on jack hammer and car noises. The proposed Ordinance is based on the City of Daytons Noise Control Ordinance. It is recommended that the section of the original Ordinance pertaining to decibel meter requirements be removed.

COMMUNICATIONS AND PRESENTATIONS
Resolution No. 28-97: Thomas McDougall
Resolution No. 28-97: A resolution acknowledging the appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by Thomas McDougall.
The Resolution was read by Mayor Gilman. Mayor Gilman presented the resolution to Mr. McDougall who was present with his wife, Jenny. Mayor Gilman thanked Mr. McDougall for his years of service on the Planning Commission and the Board of Zoning Appeals.
West Carrollton Business Advisory Council Report
Rod Rodriguez of the West Carrollton Business Advisory Council thanked the Council Members for their support of the Advisory Council. He wished to inform them that a video would be shown immediately following the Council meeting regarding the Citys Retention and Expansion Surveys done in conjunction with Dayton Power and Light. The program will highlight the ideas for improvements to the City.
COMMENTS BY THE AUDIENCE
Rick Dobson of 3131 W. Alex-Bell Road addressed Council regarding his efforts to volunteer for various Board positions. Mr. Dobson questioned the procedures for determining Board members. He feels he is qualified and would be an asset to any of the Boards. Mr. Dobson stated that he had donated services to the City but Council stopped him and instead now pays for another business to perform those services. When questioned by Mr. Sanner, Mr. Dobson stated that he had printed the brochures for the D.A.R.E. program at no charge to the City. Mr. Dobson stated that he feels that it is important to give to the youth programs. He feels that Council is deliberately excluding him from participating in various City functions, although he also feels that because he questions various actions of the Council, he is helping them to do a better job.

NEW BUSINESS
Ordinance No. 3061: Bids for Sidewalk/Curb/Gutter Repairs
Ordinance No. 3061: An ordinance authorizing the City Manger to advertise for bids for the installation and repair to curb, gutter and sidewalks and to expend a sum in excess of $10,000.00 therefore.
Mr. Sanner made a motion, seconded by Mr. Mounce, to waive the second reading of Ordinance 3061. A roll call vote was taken, all members voted yes and the motion carried. Mr. Sanner made a motion, again seconded by Mr. Mounce, to adopt Ordinance No. 3061. A unanimous roll call vote carried the motion.
Ordinance No. 3062: Bids for Alex Road Improvements
Ordinance No. 3062: An ordinance authorizing the City Manager to advertise for bids for the Alex Road Improvement and to expend a sum in excess of $10,000.00 therefore.
Mr. Ennis made a motion to waive the second reading of Ordinance No. 3062. Mr. Mounce seconded the motion. A roll call vote was taken, all members voted yes and the motion carried. Mr. Mounce then made a motion, seconded by Mr. Jensen, to adopt Ordinance No. 3062. A unanimous roll call vote carried the motion.
Resolution No. 29-97: City Council super majority vote
Resolution No. 29-97: A resolution requesting the Planning Commission to review and recommend proposed changes to the Zoning Code regarding the City Council super majority vote.
A motion was made by Mr. Mounce and seconded by Mr. Ennis to adopt Resolution No. 29-97. All members voted yes to a roll call vote and the motion carried.
REPORTS BY OFFICERS
Deputy Chief of Police Rick Barnhart presented a staff report to Council regarding the status of the Police Accreditation Program. The West Carrollton Police Department was originally accredited in March of 1992. Since then standards have been revised with which the Department was required to comply in order to continue to be accredited. The accreditation takes place every three years as opposed to the original requirement of five years. There were five days of review by the assessors during which they compared 436 standards with the West Carrollton Police Department procedures. Not all of the standards apply to every department, i.e., full-time jail. The West Carrollton Police Department met 406 standards and was recommended for re-accreditation. On July 26, 1997, the re-accreditation was awarded.
Mr. Williams thanked Mr. McDougall for all of his service to the City and commended Chief Rice, Deputy Chief Barnhart, Sgt. Charles Baker and the entire Police Department on fulfilling the accreditation requirements.
Mr. Williams noted that various changes are taking place at the Crossings Apartments due to new management. Several eviction notices have been issued and stricter criteria for applicants is being implemented.
Mr. Williams also requested an executive session to discuss a real estate matter along with the scheduled legal matter.
Mr. Williams also noted that there will be at least 2-3 weeks of inconvenience for citizens of West Carrollton due to the re-surfacing of various streets including Alex Road and appreciates the citizens understanding.
Mr. Humphreys expressed his appreciation of Mr. McDougalls service to the City, on behalf of his staff at the City.
Chief Rice thanked Mr. Williams and Council for all of their support.
UNSCHEDULED BUSINESS
There were no comments by the audience.
Mr. Mounce commended the Police Department on receiving the Accreditation and thanked Mr. McDougall for all of his hard work. Mr. Mounce asked Mr. Williams when they would receive information on the Urban Design Plan. Mr. Williams stated that the Plan is still in the preliminary stages and suggested that Council become involved in these preliminary stages.
Mr. Sanner thanked Mr. McDougall and commended the Police Department.
Mr. Ennis thanked Mr. McDougall and congratulated the Police, Fire and Service Departments for their recent awards.
Mr. Jensen thanked Mr. McDougall and commended the Police Department. Mr. Jensen noted that with the recent closure of the Fifth/Third Bank at Elm Street and Central Avenue, a new location was found for the posting of the Ordinances and Agendas. Mr. Jensen made a motion to include Farmers and Merchants Bank, along with Yordys Reliable Cleaners, Civic Center lobby, Woodys Market and Ameristop Food Mart (Elm Street & Alex Road) as the locations for posting the Ordinances and Agendas. Mr. Garrison seconded the motion. A unanimous roll call vote carried the motion.
Mr. Jensen also noted that there is now a vacancy on the Property Maintenance Appeals Board.
Mr. Garrison thanked Mr. McDougall and commended the Police Department.
Mayor Gilman thanked Tom Reilly and Vanessa Fletcher for their work on the new program, "Take a Closer Look", which airs prior to the Council meeting. Mr. Mounce commended them for taking the lead on using the video production offered by the Cable Council.
Mayor Gilman reminded everyone that there will be a 5 mile run on September 14, 1997 to celebrate 150 years of service at the Dayton and Montgomery County Public Library.
Mayor Gilman thanked Ron Ziemkowski on cameras and reminded all of the WCBAC film which airs after the Council meeting.
Mayor Gilman made a motion to recess to an executive session to discuss a real estate matter and a legal matter. The motion was seconded by Mr. Mounce. A unanimous roll call vote carried the motion.
Council recessed to an executive session.
Executive Session
Those who were present for the Executive Session in addition to the City Council were: City Manager G. Tracy Williams; Assistant City Manager David W. Rowlands; Police Chief Don Rice; Planning & Economic Development Director David Humphreys; and Law Director Pat Carney.
At the conclusion of the Executive Session, Councilmember Don Mounce moved that the City Council convene into the regularly scheduled Work Session. The motion was seconded by Councilmember Bill Ennis. All voted in favor of the motion.
Adjournment
Councilmember Jack Jensen moved to adjourn. Councilmember Don Mounce seconded the motion. All members present voting Yes, the motion carried. The meeting was adjourned.
