PRESENT: Mayor Gilman; Council members Bill Ennis, Daryl Garrison, William Gordon, Jack Jensen, Donald Mounce and Jeff Sanner; City Manager Tracy Williams; Law Director Patrick Carney; Service Director Don Hill; Police Chief Don Rice; Fire Chief Jack Keister; EMT Director Leanne Nash; Director of Planning and Economic Development David Humphreys; Parks and Recreation Director Rick Bolton; and Assistant Clerk of Council Patricia Replogle.
The meeting was called to order by Mayor Gilman. Pastor Mark Pierce of the First Presbyterian Church gave the invocation. The Pledge of Allegiance and Roll Call followed.
MINUTES
A motion was made by Mr. Sanner and seconded by Mr. Jensen to approve the minutes of the Regular Meeting of July 8, 1997 and the Joint Meeting of Council and the Planning Commission on July 10, 1997. A unanimous roll call vote carried the motion.
PUBLIC HEARINGS
There were no public hearings.
COMMUNICATIONS AND PRESENTATIONS
John Nielsen, Executive Director of the Miami Valley Risk Management Association, was present to present the Safety Awards to the Parks and Recreation Department and the Water and Waste Water Department for sustaining zero losses for the last three years. MVRMA manages the self-insurance for a group of cities in the area and conducts an annual Safety Performance Evaluation audit with each MVRMA municipality. Service Director Don Hill and Parks Director Rick Bolton accepted the awards on behalf of their departments, both of which recorded zero losses for the years 1994, 1995 and 1996. In addition Mr. Nielsen presented the Pinnacle Award to City Manager Tracy Williams and Mayor Gilman for the highest percentage of compliance of the safety performance criteria.

NEW BUSINESS
Resolution No. 27-97: Legal Action Against "Cheeks" Gentlemens Club
Resolution No. 27-97: A resolution authorizing the City Law Director to take whatever legal action may be necessary to require a business known as "Cheeks Gentlemens Club" to comply with all the West Carrollton regulations and ordinances, including the West Carrollton Zoning Code, and if necessary to commence legal proceedings against the owners, operators and employers of said business until they have complied with such regulations and ordinances.
A motion was made by Mr. Mounce and seconded by Mr. Gordon to adopt Resolution No, 27-97. A roll call vote was taken, all members voted yes and the motion carried.
Ordinance No. 3059: BOCA National Fire Prevention Code / 1996
Ordinance No. 3059: An ordinance repealing Chapter 151 of the Codified Ordinances, entitled "Fire Prevention Code", and adopting the tenth edition of the BOCA National Fire Prevention Code/1996 in its entirety, as the Code for the City of West Carrollton.
Mr. Garrison made a motion to waive the second reading of Ordinance No. 3059. Mr. Jensen seconded the motion. A unanimous roll call vote carried the motion. Mr. Garrison made a motion, seconded by Mr. Sanner, to adopt Ordinance No. 3059. A roll call vote was taken, all members voted yes and the motion carried.
Resolution No. 28-97: Thomas McDougall
Resolution No. 28-97: A resolution acknowledging the appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by Thomas McDougall.
Mr. Jensen made a motion, seconded by Mr. Mounce, to adopt Resolution No. 28-97. A unanimous roll call vote carried the motion.
Liquor License Request-Cheeks
A motion was made by Mr. Mounce to oppose the liquor license request for 906 Watertower Inc. dba Cheeks at 906 Watertower Lane in West Carrollton. Mr. Gordon seconded the motion. A unanimous roll call vote carried the motion.
REPORTS BY OFFICERS
Mr. Williams noted that there was a ribbon-cutting ceremony at the picnic shelter at Harmon Field earlier this evening. He also informed everyone that construction has begun on South Alex Road between King Richard Parkway and Route 725. The catch basins will be reconstructed at this time followed by the curb work. The paving will begin after those areas are completed.
Mr. Carney requested an Executive Session with Council after the meeting recessed.
Mr. Hill wished to thank the supervisors and employees of his department. He stated that it is due to their work that the Department received the Safety Award from MVRMA.
Mr. Bolton also commended the employees of his Department for all of their work resulting in the Safety Award.
Chief Keister thanked Council for adopting Ordinance No. 3059.
UNSCHEDULED BUSINESS
COMMENTS BY THE AUDIENCE
Rick Dobson of West Carrollton addressed Council to request consideration for a position on the Zoning Board when Thomas McDougall leaves the position. Mr. Dobson feels he would be an asset to the Board.
COMMENTS BY COUNCIL
Mr. Jensen commended the City employees on their safety record. He also made a motion to nominate Ray Snider to fill the vacancy on the Board of Zoning Appeals. Mr. Gordon seconded the motion. A unanimous roll call vote carried the motion.
Mr. Garrison, Mr. Mounce, Mr. Ennis and Mr. Sanner commended the employees on their safety record.
Mr. Mounce also noted that he is on a committee with Mr. Sanner and officials from the City of Moraine to discuss improvements to I-75. He also commented on the new signs for the Civic Center.
Mr. Ennis thanked Mr. Williams for seeing that the signs were erected at Watertower Lane.
Mayor Gilman informed Council that there would be a MVRPC Planning meeting tomorrow night . Mr. Hill noted that the meeting would be a Public Hearing regarding the long-range transportation plan for MVRPC. Mayor Gilman thank the Ziemkowskis for volunteering their time to manage the cameras for the Council meeting.
Mayor Gilman made a motion to recess to an Executive Session to discuss a legal matter and to a Work Session to discuss the items on the agenda. Mr. Gordon seconded the motion. A unanimous roll call vote carried the motion.
Executive Session
Those who were present for the Executive Session in addition to the City Council were: Police Chief Rice; Pat Carney; David Humphreys; G. Tracy Williams.
At the conclusion of the Executive Session, Bill Gordon moved that the City Council convene into the regularly scheduled Work Session. The motion was seconded by Councilmember Jack Jensen, and all voted in favor of the motion.
Work Session
Those present at the Work Session in addition to the City Council were: Rick Dobson; Jody Jones; Ed Jones; Linda Lotspaih; Gene Colon; Ray Snider; Pat Carney; G. Tracy Williams; and Chief Rice.
Noise Ordinance
Chief Rice reviewed proposed revisions to the Noise Control ordinances for the City of West Carrollton. Following discussion on this matter City Council requested that this item be placed on their agenda as a Public Hearing. Following discussion on this matter Gene Colon left.
Senior Citizens/Community Center
City Council authorized staff to proceed with having new carpet installed at the Senior Citizens Center. Council directed that the cost for this carpet be charged against the General Fund Contingency Account.
City Code Section 154.13 (A) (5)
City Manager Williams inquired as to whether Council was ready to proceed with amending the City Code with regards to Councils ability to overrule a negative recommendation from the Planning Commission on zoning issues. City Council indicated that they were waiting for a recommendation from the Planning Commission on this matter.
City Council Vision Statement
City Council requested that the Vision Statement be distributed to the Citys Boards and Commissions and to the newspapers. They also requested that an article be placed in the next City Newsletter on this matter and also that a copy be distributed to the City employees.
Comments by Council
Councilmember Jeff Sanner advised Council that Woodrow Bowman had extended an invitation to all of City Council to take a tour of his store in light of recent publicity about the sanitary conditions at his facilities. City Council indicated that they would be available to tour Woodys Market on Tuesday, July 29, at 7:30 p.m.
Councilmember Jeff Sanner inquired about the status of our plans to install a new radio system in the City. Williams indicated that Chiefs Rice and Keister have done substantial work on this matter, and that he expected a final report to be prepared within the next few weeks. Williams indicated that this would be a substantial expenditure of approximately $.5 million and that a full presentation would be made to City Council on the proposed new radio system.
Deputy Mayor Bill Gordon inquired as to why the swimming pool closed at 6:00 p.m., on Monday, July 21, and also expressed concern about the closure of the diving well on Sunday evening, July 20. City Manager Williams said that he would discuss this matter with staff to find out why early closures were made at the swimming pool.
Councilmember Don Mounce reported on the meeting which he and Councilmember Sanner had with representatives from Moraine regarding the Committee which is studying possible improvements to the I-75/Central Avenue/Dixie Drive interchange, as well as the Dryden Road intersection with Central Avenue. He indicated that the Committee was going to take a further look at Option 2 from the previous report done on this matter.
Rick Dobson
Rick Dobson, who lives at 3131 Alex-Bell Road, inquired about the possibility of obtaining copies of information which the City Council had so that he could participate more fully in discussions at City Council work sessions. City Council explained to Mr. Dobson that City Council work sessions were primarily a time for interaction amongst the City Council and City staff.
City Manager Williams noted that he had contacted Gene Colon, Jody Jones and Linda Lotspaih, and would be contacting other persons who might run for Council, to advise them that he would provide information they might request and encouraged them to contact him if they had any citizen concerns that could be addressed during the campaign season. He indicated he desired to treat everyone fairly and to ensure prompt service to the citizens.

Deputy Mayor Bill Gordon moved to adjourn. Councilmember Don Mounce seconded the motion. All members present voting Yes, the motion carried. The meeting was adjourned.
