May 27, 1997

PRESENT: Mayor Maxine Gilman; Council members Bill Ennis, Daryl Garrison, William Gordon, Jack Jensen, Donald Mounce and Jeff Sanner; City Manager Tracy Williams; Assistant City Manager David W. Rowlands; Law Director Patrick Carney; Finance Director Tom Reilly; Service Director Don Hill; Police Chief Don Rice; Fire Chief Jack Keister; Recreation Director Rick Bolton; Assistant Clerk of Council Patricia Replogle.

 

 

The meeting was called to order by Mayor Gilman at 7:30 p.m. Michael Lockwood of Abundant Life Baptist Church gave the invocation. The Pledge of Allegiance and Roll Call followed.

 

 

Minutes

 

A motion was made by Mr. Sanner and seconded by Mr. Garrison to approve the minutes of the Regular Meeting of May 13, 1997. A roll call vote was taken. Mr. Ennis abstained. All other members voted Yes and the motion carried.

 

Mr. Garrison made a motion to approve the minutes of the May 20, 1997, Work Session. Mr. Gordon seconded the motion. A roll call vote was taken. Mayor Gilman abstained. All other members voted Yes and the motion carried.

 

 

Public Hearings

 

There were no public hearings.

 

 

Communications and Presentations

 

Resolution No. 16-97: Peggy Proto

 

Resolution No. 16-97 - A resolution acknowledging the appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by Peggy Proto.

 

Mayor Gilman read Resolution No. 16-97 in its entirety and presented it to Peggy Proto, thanking her for all of her time and service to the City and wishing her luck in her move to Boston. Mrs. Proto thanked the Mayor, Council Members and the City staff for their support and good wishes.

 

 

Resolution No. 17-97: Wilney Markham

 

Resolution No. 17-97 - A resolution acknowledging the appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by Wilney Markham.

 

Chaplain Markham, accompanied by his wife, was presented with the resolution by Mayor Gilman, Chief Rice, and Officer Jarman. Chief Rice expressed his appreciation for the time and effort Chaplain Markham has given to the City, particularly to the Police Department. Chief Rice noted that when the citizens need help, they call the Police Department, and when the Police Department needs help, they turn to Chaplain Markham. The Mayor echoed these sentiments and wished Chaplain and Mrs. Markham well.

 

 

Resolution No. 18-97: John Wambold

 

Resolution No. 18-97 - A resolution acknowledging the appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by John Wambold.

 

Mayor Gilman and Tom Reilly presented the resolution to John Wambold. Mr. Reilly expressed the appreciation and best wishes of his co-workers, stating that John was an outstanding person and would do well in his new career.

 

 

Resolution No. 19-97: Jeromy Lewis and Nicole Smith

 

Resolution No. 19-97 - A resolution recognizing the West Carrollton High School Class of 1997 Valedictorian, Jeromy Lewis, and Salutatorian, Nicole Smith, and honoring their academic excellence.

 

Mayor Gilman read the resolution. The Mayor noted that Jeromy Lewis was unable to attend, but presented Nicole and her parents with Nicole’s resolution. The Mayor complimented Nicole on her achievements.

 

 

Presentation by Rotary Club for Fire Department

 

Jim Eckstrom, President of the West Carrollton Rotary Club, presented Chief Keister with a check for $2,000.00 for use in purchasing a Heart Simulator/Trainer. Chief Keister expressed sincere thanks to the Rotary Club for their gift. Chief Keister explained that the Simulator would train the Fire Department/EMT personnel to determine the appropriate treatment in emergencies.

 

 

Mayor Gilman moved to amend the agenda to include a presentation by D.A.R.E. Officer Gene Jarman. Mr. Garrison seconded the motion. A unanimous roll call vote carried the motion.

 

 

 

D.A.R.E. Presentation to Cub Scouts Den 4, Pack 825

 

Officer Jarman presented Cub Scout Den 4, Pack 825 from Harold Schnell School, with cards for completion of the D.A.R.E. program along with pins and Papa John Pizza coupons. Officer Jarman presented the items to Den Leaders, Clara Smith and Joanie Pierce, and to the Scouts: Nicholas Smith, Tommy Gagin, Jessie LeMaster, Jeff Patterson, Scott Patterson and Matthew Pierce.

 

Officer Jarman also thanked Chaplain Markham for all of his help personally and with the West Carrollton Police Department, including help organizing Bible study for the officers.

Unfinished Business

 

Ordinance No. 3053 - Dayton Power & Light

 

Ordinance No. 3053 - An ordinance granting the Dayton Power and Light Company, its successors and assigns, authorization to supply electricity in the City of West Carrollton, State of Ohio, for the period of five (5) years, automatically renewing for successive terms of five (5) years unless notice is given, commencing on the effective date of this ordinance.

 

Mr. Jensen was excused from this discussion and left the room.

 

Mr. Mounce noted that questions at the previous meeting regarding DP&L’s billings were not meant to be reflective on quality but merely as to procedure. Mr. Mounce then made a motion to adopt Ordinance No. 3053. Mr. Sanner seconded the motion. All members present voted Yes and the motion carried.

 

Mr. Jensen returned to the meeting.

 

 

New Business

 

Resolution No. 20-97: Sidewalk, Curb, Gutter Construction

 

Resolution No. 20-97 - A resolution declaring a necessity that certain sidewalks, curbs and gutters shall be constructed.

 

Mr. Jensen made a motion, seconded by Mr. Garrison, to adopt Resolution No. 20-97. A unanimous roll call vote carried the motion.

 

Resolution No. 21-97: Workers’ Compensation Group Rating Plan - 1998

 

Resolution No. 21-97 - A resolution authorizing the City of West Carrollton’s participation in the Miami Valley Risk Management Association’s Workers’ Compensation Group Rating Plan for 1998.

 

A motion was made by Mr. Mounce, seconded by Mr. Gordon, to adopt Resolution No. 21-97. A roll call vote was taken. All members voted Yes and the motion carried.

 

 

Resolution No. 22-97: Technology Advisory Group

 

Resolution No. 22-97 - A resolution establishing a Technology Advisory Group for the City of West Carrollton.

 

Mr. Jensen made a motion to adopt Resolution No. 22-97. The motion was seconded by Mr. Sanner. A unanimous roll call vote carried the motion.

 

 

Reports by Officers

 

Mr. Williams thanked Chaplain Markham for his service to the community and to the Police Department. He also thanked all those involved with the opening of the new pool. Mr. Williams informed everyone that the "Watertower Lane Project" (running along S.R. 725) would begin again on Thursday and should be completed Friday or Saturday. There had been a delay but after various phone calls the problem appears to be resolved. Mr. Williams also informed Council that due to the retirement of Tom Mick, Tom Scherack has been appointed Utility Superintendent, effective July 7, 1997.

 

Mr. Carney apologized to Council for the delay in getting the memo to them.

 

Mr. Bolton thanked Peggy Proto for all of her services to the City.

 

 

Unscheduled Business

 

There were no comments by the audience.

 

Mr. Ennis thanked Chaplain Markham, the Rotary Club and Officer Jarman. He offered his congratulations to the Cub Scouts and their leaders.

 

Mr. Jensen echoed the thanks of Mr. Ennis and included thanks to Peggy Proto. He also complimented the Recreation Department on the new Pool.

 

Mr. Garrison also thanked Mrs. Proto and Chaplain Markham, congratulated the Scouts and invited the citizens to enjoy the Pool.

 

Mr. Mounce added his thanks to those already mentioned, as did Mr. Sanner. Mr. Sanner also thanked Chaplain Markham for being of service to him.

 

Mr. Gordon thanked Chaplain Markham and wished Mrs. Proto good luck. He also noted that the Paper Festival will be June 13-June 15 with the parade being at 10:00 a.m. on June 14, and the 5K Run/Walk scheduled for 9:00 a.m., June 15. He also mentioned there will be a Golf Outing on June 20 at River Bend Golf Course.

 

Mayor Gilman mentioned that she had seen Marlene Palmatary who is doing well. The Mayor also read a letter she had received from the commercial builder who had worked on the City Pool. Michael G. Truax, the builder, wanted to express his appreciation and compliments to the City’s staff. He wrote that he had never worked with a more efficient team than Rick, Dixon and their staff. Mayor Gilman also thanked the cameraman, Ron Ziemkowski, and complimented the Police Department on their accreditation public hearing.

 

Mayor Gilman made a motion to recess to a work session to discuss the items of the agenda. Mr. Gordon seconded the motion. A roll call vote was taken. All members voted Yes and the motion carried.

 

 

Work Session

 

In addition to City Council, City Manager Tracy Williams; Assistant City Manager, Dave Rowlands; Law Director, Pat Carney; and guest Ray Snyder were present.

 

 

Zoning Ordinance

 

Pat Carney distributed draft legislation for City Council to review pertaining to the issue of a super majority vote needed by City Council to overrule a negative recommendation on a rezoning matter from the Planning Commission. After discussion Mr. Carney was requested to draft an ordinance for City Council.

 

Mr. Mounce requested a meeting be held between the Planning Commission and City Council.

 

Mr. Carney left the meeting.

 

 

Income Tax

 

Tom Reilly, Finance Director, gave a review of the status of the income tax revenue stream and distributed a tax receipt graph to City Council. Mr. Reilly explained how businesses affect this revenue stream.

Adjournment

 

Council reconvened to the Regular Session. Having no further business, Councilmember Don Mounce moved to adjourn. Councilmember Garrison seconded the motion. All members present voting Yes, the motion carried. The meeting was adjourned.
