West Carrollton City Council Meeting

November 24, 1998

 

 

PRESENT: Mayor Maxine Gilman; Council Members William Gordon, Jack Jensen, Linda Lotspaih, Jeff Sanner, and Bill Ennis; City Manager G. Tracy Williams; Assistant City Manager David Watson; Law Director Patrick Carney; Service Director Don Hill; Parks and Recreation Director Rick Bolton; Police Chief Don Rice; Fire Chief Jack Keister; and Assistant Clerk of Council Patricia Replogle.

EXCUSED: Councilmember Donald Mounce.

The meeting was called to order by Mayor Gilman. Dana Brown, Chaplain of the West Carrollton Police Department, gave the invocation. The Pledge of Allegiance and Roll Call followed.


MINUTES

A motion was made by Mr. Gordon to approve the minutes of the Regular Council Meeting of November 10, 1998. Mr. Jensen seconded the motion. A roll call vote was taken. Mr. Sanner and Mr. Ennis abstained; all other members present voted yes. The motion carried.

A motion was made by Mr. Ennis, seconded by Mrs. Lotspaih, to approve the minutes of the Work Session of November 17, 1998. A roll call vote was taken. All members present voted yes with the exception of Mr. Sanner who abstained. The motion carried.


PUBLIC HEARINGS

There were no Public Hearings.


COMMUNICATIONS AND PRESENTATIONS

There were no Communications or Presentations.

UNFINISHED BUSINESS

ORDINANCE NO. 3106: VACATING PORTION OF FARMERSVILLE-W. CARR ROAD

Ordinance No. 3106 (second reading): An ordinance vacating a portion of old Farmersville-West Carrollton Road between Hydraulic Road and the Great Miami River.

Mr. Jensen noted that he had received the information he had requested and was satisfied. He then made a motion to approve Ordinance No. 3106. Mr. Sanner seconded the motion. All members present voted yes to a roll call vote and the motion carried.


NEW BUSINESS


RESOLUTION NO. 28-98: GEORGE BOCKERSTETTE

Resolution No. 28-98: A resolution acknowledging the appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by George Bockerstette.

Mr. Ennis introduced and made a motion to adopt Resolution No. 28-98. Mr. Gordon seconded the motion. A unanimous roll call vote carried the motion.


RESOLUTION NO. 29-98: APPRECIATION OF CAREFLIGHT

Resolution No. 29-98: A resolution expressing the support and appreciation for the Miami Valley Hospital's CareFlight Program on the occasion of the fifteenth anniversary of the air ambulance program.

Mr. Ennis introduced and made a motion to adopt Resolution No. 29-98, seconded by Mrs. Lotspaih. A unanimous roll call vote carried the motion.


OCCUPANCY AGREEMENT WITH MONTGOMERY COUNTY COMBINED HEALTH

DISTRICT FOR USE OF A PORTION OF THE BUILDING AT 31 N. LOCUST STREET

Mayor Gilman noted that this is the same 3 year agreement as in the past. Mr. Williams added that it contains a 90 day cancellation clause for either party. Mr. Jensen asked Mr. Williams to give an overview of the Children & Youth Clinic operated at that location by the Health District. Mr. Williams noted that the facility at 31 North Locust Street is operated by the Montgomery County Combined Health District. The facility is staffed by nurses and doctors and provides immunizations and other services to the youth in the area. Fees are based on income with the focus on preventative medicine. Mr. Sanner made a motion, seconded by Mr. Gordon, to authorize the City Manager to enter into an occupancy agreement with the Montgomery County Combined Health District for lease of a portion of the building at 31 North Locust Street in West Carrollton for a Children and Youth Clinic. All members voted yes to a roll call vote and the motion carried.


AGREEMENT WITH THE CITY OF MIAMISBURG FOR JOINT EMPLOYMENT OF ANIMAL CONTROL OFFICER

Mayor Gilman noted that this is the same agreement as in the past with 40% of the cost going to West Carrollton and 60% to Miamisburg. Mr. Jensen made a motion, seconded by Mrs. Lotspaih, to authorize the City Manager to enter into an agreement with the City of Miamisburg to provide animal control services by jointly employing an animal control officer and sharing the total costs thereof. A roll call vote was taken, all members voted yes and the motion carried.



REPORTS BY OFFICERS

Mr. Williams requested an Executive Session to discuss personnel matters. He also noted that the contractor on the Marina Drive project will have the majority of the work completed by tomorrow. Mr. Williams wished everyone a Happy Thanksgiving.

COMMENTS BY COUNCIL

Mr. Gordon wished everyone a Happy Thanksgiving. He also expressed his sympathies to the Gilman and Thompson families for their losses. (Chris Thompson's husband died recently.) Mr. Gordon also expressed his admiration of Mayor Gilman for being at the Council meeting after the recent loss of her daughter-in-law, Jean Gilman.

Mr. Ennis echoed Mr. Gordon's comments.

Mr. Jensen expressed his sadness at the loss of Jean Gilman and added that he knew her well from all of the work she did for the School Board and other committees. He said she will be greatly missed.

Mrs. Lotspaih offered her prayers to Mayor Gilman and her family. She noted that the Holiday Festival will be held on November 30th and will include the annual Christmas tree lighting along with crafts and horse trolley rides. Mrs. Lotspaih wished everyone a Happy Thanksgiving.

Mr. Sanner also wished everyone a safe and happy Thanksgiving. He also expressed his admiration of Mayor Gilman and said his prayers are with her and her family.

Mayor Gilman noted that the trolley rides at the Festival will be $2.00 for age 10 and over and $1.00 for those under 10 years old. Homes Tours will be held December 6th from 1:00 p.m. to 5:00 p.m. Mayor Gilman also noted that the City Beautiful Commission is accepting nominations for recognition of some of the residents' holiday decorations. She noted that this year the City will be accepting letters for Santa from children up to 12 years of age. Letters may be brought or mailed to the Parks and Recreation Department at the City Building along with a self-addressed, stamped envelope.

Mayor Gilman thanked Ron Ziemkowski on cameras. Mayor Gilman said she had received a letter from the Gerald Smith Family expressing their thanks to the West Carrollton Police and Fire Departments for all their help during a fire at their home on November 17th. Mayor Gilman also expressed her appreciation of the Police and Fire Departments for all of their help recently.

A motion was made by Mayor Gilman and seconded by Mr. Gordon to recess to an Executive Session to discuss a personnel matter and to a Work Session to discuss the items of the agenda. A unanimous roll call vote carried the motion.

Council recessed.


EXECUTIVE SESSION

Those who attended the Executive Session, in addition to the City Council members present, included Police Chief Don Rice; Attorney Janet Cooper; Assistant City Manager David Watson; and City Manager G. Tracy Williams.

Following the Executive Session, Councilmember Jeff Sanner moved that the Council convene into the Work Session. The motion was seconded by Deputy Mayor Bill Gordon. All voted in favor.

Attorney Janet Cooper left the meeting.

WORK SESSION

The City Council decided to postpone discussion on the items scheduled for this Work Session until a later time.

City Council signed a Statement of Beliefs and Commitment prepared by the School Board/Government Liaison Committee. It was noted that this document would be circulated to the other elected officials for their signatures also, in preparation for the upcoming press conference on this matter.

Several of the council members indicated that they had been contacted by Mrs. Audrey Smith with regard to her concerns about the dog owned by the residents who live next to her. Mrs. Smith has expressed concerns about the impact the barking of this dog has had on her health. Chief Rice distributed a survey which his department had recently completed concerning how other communities are addressing barking dog issues. City Council indicated that they would give this matter further consideration, and may discuss it further at a later time.


ADJOURNMENT

Councilmember Jensen moved, and it was seconded by Deputy Mayor Bill Gordon, that the meeting be adjourned. All voted in favor. The meeting was adjourned.
